Zero Tolerance Policy on Child Sexual Abuse and Exploitation (CSAE)

1. Policy Statement
SKLoud Software Development Services is fully committed to protecting children and youth users on its platform. We enforce a Zero Tolerance Policy against Child Sexual Abuse and Exploitation (CSAE) in any form, including but not limited to online grooming, sexual solicitation, production or dissemination of child sexual abuse materials (CSAM), and any sexually exploitative conduct involving minors.
This commitment is rooted in our compliance with:
- Republic Act No. 7610 (Special Protection of Children Against Abuse, Exploitation and Discrimination Act)
- Republic Act No. 9775 (Anti-Child Pornography Act of 2009)
- Republic Act No. 10175 (Cybercrime Prevention Act of 2012)
- Republic Act No. 11930 (Anti-Online Sexual Abuse or Exploitation of Children Act of 2022)
- United Nations Convention on the Rights of the Child (UNCRC)
SKLoud shall take immediate and decisive action — including permanent account termination, law enforcement reporting, and legal cooperation — against any individual, organization, or official found to have violated this policy.
2. Scope and Applicability
This policy applies to:
- All users of SKLoud App, including SK officials, youth members, volunteers, and organizations.
- All employees, interns, and contractors of SKLoud Software Development Services.
- All partners, sponsors, and third-party service providers who access or handle youth-related data.
- All communications, data, and content transmitted through SKLoud’s systems, including chat, multimedia, and uploaded documents.
3. Definition of CSAE
For the purpose of this policy, Child Sexual Abuse and Exploitation (CSAE) includes:
- Production, distribution, access, or possession of Child Sexual Abuse Material (CSAM).
- Online grooming or sexual solicitation of minors through chat, posts, or direct messages.
- Coercion, manipulation, or offering of money, gifts, or benefits in exchange for sexual content or favors.
- Sexualized language, jokes, imagery, or insinuations directed at minors.
- Any attempt or conspiracy to commit the above acts.
4. Prohibited Behaviors
SKLoud strictly prohibits:
- Uploading, sharing, or transmitting sexually explicit or suggestive materials involving minors.
- Using the platform for grooming, solicitation, or predatory behavior.
- Impersonating minors or using false identities to engage with youth users.
- Retaining, forwarding, or failing to report CSAE-related content.
- Accessing or leaking youth user information for exploitative purposes.
5. Reporting, Investigation, and Enforcement
a. Reporting Channels
- In-app 'Report User / Report Content' button for immediate flagging.
- Direct reporting via childsafety@skloud.app or to the Child Protection Officer (CPO).
- Emergency coordination with PNP-Women and Children Protection Center (WCPC) or NBI-Cybercrime Division.
b. Response Protocol
- All CSAE reports are treated as critical and confidential.
- The Child Protection Response Team (CPRT) will investigate within 24 hours.
- Immediate suspension of the reported account will occur during verification.
- Confirmed cases are escalated to law enforcement and logged for permanent record.
c. Sanctions
- Permanent account termination and data blacklisting.
- Reporting and cooperation with law enforcement for criminal prosecution.
- Administrative sanctions for SKLoud employees or partners (termination, disqualification, legal action).
6. Data Protection and Safeguards
- All youth-related data are encrypted, access-controlled, and subject to audit logging.
- No employee or admin may access youth personal data without written authorization and legitimate purpose.
- Systems use AI-powered monitoring and keyword detection filters to identify potential grooming or CSAE activity.
- Any detected content is automatically quarantined, reviewed, and, if necessary, reported to authorities.
7. Prevention and Education
- All SKLoud staff, SK admins, and partners shall undergo mandatory annual training on Child Protection and Online Safety.
- SKLoud shall publish child safety reminders and online conduct guidelines to users upon registration.
- Awareness modules on digital citizenship and reporting abuse shall be integrated into the SKLoud onboarding process.
8. Accountability and Review
- The SKLoud Child Protection Officer (CPO) is responsible for policy implementation and compliance monitoring.
- The policy will be reviewed annually or as required by new laws and technologies.
- SKLoud will maintain an incident log (non-public) of all CSAE reports for audit and transparency.
